Family Law encompasses legal issues related to family relationships, including marriage, divorce, child custody, adoption, and domestic violence.
Marriage and Divorce Law
Family law governs the legal aspects of entering into and dissolving marriages, including the requirements for a valid marriage, the grounds for divorce, and the division of marital property.
It also addresses issues such as spousal support (alimony) and the termination of legally recognized relationships like civil unions and domestic partnerships.
Child Custody and Support Law
Family law establishes the legal framework for determining child custody and visitation rights, ensuring that decisions are made in the best interests of the child.
It also outlines the obligations of parents to support their children financially.
Adoption and Surrogacy Law
-
Family law governs the legal processes involved in adopting a child, including the termination of parental rights and the establishment of new parent-child relationships.
-
It also addresses the legal aspects of surrogacy arrangements.
Domestic Violence / Protection From Abuse Law
Family law provides legal protections for victims of domestic violence, including the ability to obtain restraining orders or protective orders.
You are eligible to petition for a Protection From Abuse (PFA) order against an abuser who is one of the following: a spouse or former spouse, someone you have lived with as a couple, a person with whom you share a child, someone you are currently dating or have dated in the past, or a relative.
Addressing and Resolving Familial Disputes
Family law plays a vital role in protecting the legal rights and well-being of individuals and families during some of their most challenging times. It provides a compassionate framework for addressing and resolving familial disputes, such as those that arise during divorce, child custody battles, and support issues. The goal of family law is to ensure that all parties involved are treated fairly and equitably, with a strong emphasis on safeguarding the best interests of children and other dependents.
Adoption, Domestic Partnerships, and the Rights of Unmarried Couples
Our attorneys handle essential matters, including adoption, domestic partnerships, and the rights of unmarried couples. As our society continues to evolve, family law adjusts to reflect these changes, ensuring that the legal system remains relevant and responsive to the diverse needs of modern families.
Protection from Abuse Orders (PFA)
The first step is to file a petition for an emergency order. This is intended to protect you and any children you may have from immediate danger. The petition can be based on actual instances of mental, emotional, or physical abuse or on perceived threats. Emergency orders are often granted quickly, and the other party will be notified and prohibited from having any contact with you.
A hearing will be scheduled, usually within a week, to determine whether a permanent Protection From Abuse (PFA) order should be issued. During this hearing, you will have the opportunity to present evidence of the abuse or threats you have experienced. A judge will then decide if a permanent PFA is necessary. If granted, the PFA can remain in effect for up to two years.
It’s important to understand that during the hearing, the individual who has been threatening or abusing you has the right to respond and challenge the order. However, one of our attorneys will be by your side to advocate for your rights.
We have offices in Georgetown, DE, and Salisbury, MD, where our experienced attorneys can assist you in petitioning for a protection from abuse (PFA) order through the court.
Violation of Probation Representation (VOP Hearings)
Whether you have been sentenced in the Court of Common Pleas or Superior Court, if the court has asked you to complete certain tasks/requirements, you will be ordered to report to the Probation Office. It is essential that you comply with the terms of your probation and adhere to its rules.
You must contact an attorney as soon as possible if you violate your probation.
